Ana specialises in civil, commercial and criminal litigation and in arbitration.
She has extensive experience in procedural matters, particularly acting as lead counsel in civil, commercial and criminal litigation (First Instance, Appeal, cassation appeals, review and extraordinary appeals for procedural infringement, interim measures and enforcement of domestic and foreign judgments) in:
Commercial law (international sale of goods contracts, distribution, franchising, patents and trademarks, unfair competition, software, telecommunications).
Corporate law (challenges to corporate resolutions, shareholder disputes, sale and purchase of companies, corporate and individual actions for directors’ liability; piercing the corporate veil).
Insurance law (claims for damages under civil liability insurance).
Insolvency law (voluntary insolvency petitions).
Real estate law (real estate investment transactions, sale and purchase of properties, pre-emption rights, claims for liability and latent defects in construction, turnkey contracts, leases, adverse possession, double registration, double sale, among others).
Inheritance law (challenges to wills or testamentary clauses, disinheritance, formalisation of holographic wills).
Banking law (swaps and other derivatives, preference shares, floor clauses, interest limitation clauses, default interest, enforcement of security).
